Jonathan Swain successfully argues for the discharge of a client in respect of a European Arrest Warrant from Romania07 April 2021
The EAW, issued by a Court in Romania, sought the extradition of the client to serve a sentence of one year and eight months’ imprisonment for offences of burglary in 2013.
Mr Swain argued that the warrant was invalid under the Extradition Act 2003 as the sentence also related to an offence of driving without a licence in 2010; none of the information about that offence was contained in the warrant. The client, a Romanian man who had lived in the UK since 2018, was discharged by the District Judge. There was no appeal against the decision.
